Section 1. Introduction & Acceptance

These Terms of Service ("Terms") govern your access to and use of the crypto-to-crypto instant-exchange service operated at SnapSwap ("we", "us", "our", "Service"). By initiating or completing any transaction, visiting our website, or contacting our support team, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, do not use the Service.

Section 2. Eligibility & User Responsibilities

1. Age & Capacity – You must be at least 18 years old and have full legal capacity.

2. Local Legality – It is solely your responsibility to determine whether the use of cryptocurrency or this Service is lawful in your country or territory.

3. Restricted Locations – You may not use the Service from any jurisdiction where crypto transactions are prohibited, restricted, or sanctioned. You warrant that you are not located in, or sending funds from, any sanctioned state or address and that your funds are not derived from criminal activity.

4. Lawful Purpose Only – You agree not to use the Service for money-laundering, terrorist financing, fraud, child exploitation, sanction evasion, mixer or tumbler services, ransomware payments, or any other unlawful purpose.

5. Accurate Information – You must provide accurate transaction details (amount, currency, blockchain, address, tag/memo if required). You may not use the Service on behalf of any third party or impersonate another person.

6. Wallet Security – You are solely responsible for securing the wallets and private keys that control your cryptocurrency. Once we send coins to the address you supplied, our obligation is fully discharged.

Section 3. Description Of Services

We provide a registration-free, technical interface that allows users to swap one cryptocurrency for another.
You initiate an exchange by selecting the desired coins, providing your destination wallet address, and sending your crypto to the deposit address we generate.
You do not create an account or store balances on our platform. We temporarily hold your deposit only for the time required to complete the exchange or refund. We do not offer user accounts, hosted wallets, or long-term custody.

We are not a bank, broker, investment adviser, or payment service provider. No information on our site constitutes investment or tax advice.

Section 4. AML / KYC & Compliance

1. Automated Screening – All deposits are automatically screened by blockchain-analytics tools. Funds linked to sanctions, mixers, hacks, or high-risk scores will be refused or refunded (minus network and screening fees).

2. KYC on Demand – We do not ordinarily collect identification documents. If a third-party liquidity provider, compliance partner, or law-enforcement agency requires verification, we may request government ID, proof of address, source-of-funds, or other documents.

3. User Cooperation – Failure to provide requested KYC/AML documents within the stated deadline may result in continued freezing of the funds and eventual forfeiture as required by applicable law.

4. Law-Enforcement Requests – We will freeze and, where legally required, hand over funds upon receipt of a valid court order, police request, or comparable legal mandate.

5. No Liability for AML/KYT – We are not responsible for delays, losses, or third-party actions resulting from compliance checks or law enforcement investigations.

Section 5. Order Mechanics

1. Order Types

Fixed-Rate – Rate locked when you create the order, provided you meet our timing requirements and send the correct amount.
Float-Rate – Rate determined at the time we receive your deposit on-chain and remains market-driven until you confirm.

2. Deposit Address & Time Limits

Each order has a unique deposit address. You must send the coins to that address within the stated timeframe. Late or double deposits may be refunded (minus network fees) or rejected.

For fixed-rate orders, the lock window is shown on the order page. Sending funds outside this window may result in a float-rate conversion or refund.

You are responsible for sending the exact amount (within the stated tolerance band) and paying any network fees that do not reduce your deposit below the minimum.

3. Completion & Delivery

Once we confirm the deposit on-chain and verify that no AML/KYT flags appear, we send the exchanged cryptocurrency to your specified destination address.

We typically aim to complete the exchange within 5-30 minutes of confirmation, though delays may occur due to blockchain congestion, compliance checks, liquidity availability, or third-party platform maintenance.

4. Incorrect Information

You must verify that your destination address, memo/tag, blockchain network, and currency details are correct.
If you provide a wrong address or tag, or the wrong network (e.g., send BTC when you wanted BTC on the Lightning Network), we cannot guarantee recovery of your funds.
We may attempt to recover or refund such transactions, subject to technical feasibility, network fees, and a potential recovery fee (which may be as high as 30%-50% of the transaction value).

5. Partial Orders & Minimum Amounts

Each coin-pair has minimum and maximum limits. Orders that fall outside these limits cannot be processed.

If you deposit an amount that is slightly above or below the expected amount, we may adjust the output or refund the difference (minus fees).

6. Price Volatility

Cryptocurrency prices are extremely volatile. Float-rate orders are subject to real-time market fluctuations, and we are not liable if the rate changes between order creation and on-chain confirmation.

Fixed-rate orders shield you from market movements during the lock window, but if you exceed the lock time, your order may convert to float-rate.

We reserve the right to adjust or refuse an order if there is evidence of market manipulation, unusual price swings, or an attempt to exploit rate differences across platforms.

7. Cancellations & Modifications

Once you send cryptocurrency to the deposit address, the order is considered initiated. We do not support order cancellation after the deposit is made unless no on-chain confirmations have occurred.

If you sent the wrong coin or the wrong amount, do not send additional funds without contacting support first.

Section 6. Refunds & Failed Orders

1. Refund Conditions – Refunds are issued when: (a) an order cannot be completed for reasons beyond your control, (b) you sent the wrong coin or network, (c) AML/KYT flags block the transaction but you provide sufficient documentation, or (d) we determine a refund is appropriate in our discretion.

2. Refund Fees – Refunds are subject to network fees (for sending the coins back) and a processing fee (typically 1%-5% of the transaction value) plus any third-party compliance or recovery costs.
3. No Guaranteed Recovery – If funds are lost due to an incorrect address, wrong network, or user error, we may be unable to retrieve them. We do not guarantee refunds for such cases.
4. Timing – Refunds typically occur within 24-48 hours after resolution. Delays may occur if additional investigation or recovery steps are required.

5. Receiving Address – The refund is usually sent to the original sending address or the address from which you initiated the deposit. If this is impossible or unsafe, we may ask you to provide an alternative address with proof of ownership.

6. Blockchain Confirmations – Refund transactions still require on-chain confirmations. Delays or high network fees in the underlying blockchain network are outside our control.

7. No Double Refunds – If you have already received a refund or partial refund for a given order, you may not request a second refund or credit unless you can prove that the first refund did not occur.

Section 7. Third-Party Services & Liquidity Providers

We may use third-party exchanges, liquidity providers, or blockchain infrastructure services to facilitate trades. These third parties operate independently and are not under our direct control.
We are not responsible for outages, delays, technical failures, or security breaches at third-party platforms.
In some cases, you may be subject to additional terms and conditions imposed by a third-party provider (e.g., an exchange, a crypto service, or a chain bridge). It is your responsibility to comply with those terms.

Section 8. Risks & Disclaimers

1. Cryptocurrency Volatility – Crypto prices can change drastically in seconds. We are not liable for losses caused by market volatility, whether you use fixed or float rates.

2. Blockchain Delays – Confirmations may take longer than expected due to network congestion or miner/validator fees. We are not liable for delays caused by underlying blockchains.

3. Software & Service Bugs – While we strive for secure and reliable software, bugs or technical issues can occur. We disclaim all warranties regarding uptime, uninterrupted access, or error-free operation.

4. No Investment Advice – We do not provide investment, financial, or tax advice. You are solely responsible for evaluating the risks and legal implications of trading cryptocurrencies.

Section 9. Limitation Of Liability & Indemnification

1. No Consequential Damages – To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, punitive, or special damages, including lost profits, lost data, or lost opportunities.

2. Cap on Liability – If we are found liable for any claim, our total liability shall not exceed the value of the transaction at issue (i.e., the funds you deposited for the exchange). In no event shall our liability exceed 5,000 USD in the aggregate per user per calendar year.
3. Indemnification – You agree to indemnify and hold us harmless from any claims, losses, liabilities, or expenses (including legal fees) arising from: (a) your violation of these Terms, (b) your violation of applicable law, (c) your breach of any third-party rights, or (d) your use of the Service.

4. Force Majeure – We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, war, civil unrest, cyberattacks, or network failures.

Section 10. Service Modifications & Downtime

1. Right to Modify – We reserve the right to modify, suspend, or discontinue any feature or the entire Service at any time, with or without notice.
2. Scheduled & Unscheduled Maintenance – We may conduct maintenance that temporarily limits or disables certain features. We will attempt to provide advance notice when possible but do not guarantee uninterrupted availability.
3. No Guarantees – The Service is provided on an "as is" and "as available" basis. We make no warranties of merchantability, fitness for a particular purpose, or non-infringement.

Section 11. Taxes & Regulatory Compliance

It is your responsibility to determine what taxes (income tax, capital gains, value-added tax, or other) apply to your cryptocurrency transactions and to report and pay them accordingly. We do not provide tax advice and do not withhold or report taxes on your behalf unless legally required.

Section 12. Dispute Resolution & Arbitration

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration (unless prohibited by your local law). The arbitration will take place under the rules of a recognized arbitration body. Each party shall bear its own costs, and the arbitrator's decision is final. If arbitration is unenforceable, disputes shall be brought in the courts of the jurisdiction in which we are established, and you consent to the jurisdiction and venue of those courts.

Section 13. Changes To These Terms

We may update these Terms from time to time. The "Last Updated" date will reflect the most recent revision. Your continued use of the Service after such changes constitutes acceptance. If you do not agree with the new Terms, you must stop using the Service.
